It is my understanding that the DWP are already preparing themselves for a reprimand from Brussels in respect of their quite deliberate act of discrimination against pensioners in France, Spain,
and e.t.c. by refusing to continue to pay WFA to them.
Their website makes clear that WFA must be applied for which is a legal get out if they are punished for not paying it out this year. Their defence
will be “Well they have not applied for it so we do not have to pay it”.
This unfortunately is the mark of one Ian Duncan Smith and his supporters who will go to any length to stop us receiving
what is rightly and legally due to us.
This is my advice: -
Go to the DWP Web-site download the application form to claim your Winter
Fuel Allowance. Write a letter of complaint in support of your legitimate claim. Complete the claim form, make a copy of it and send it to them by Recorded Mail.
a copy of your proof of sending along with the copy of your letter and completed form somewhere safe in case they deny ever receiving it. Staple your application form and letter together to avoid the excuse “WE DIDN’T FIND YOUR LETTER IN THE ENVELOPE”.

Please find enclosed my completed
application for Winter Fuel Allowance for Winter 2015/16 since it has not been received by me this year as in previous years.
I have noted your comments under ‘Part 6 Notes’ which states that my country
of residence has been excluded from those EEA countries where this benefit is now to be paid but I consider this action to be unlawful.
As such, I believe that I have a legitimate right to claim for the continuance
of this allowance which was first awarded to me in England and thereafter agreed to be continued in Spain by your department.
The contrived temperature criteria employed to remove individuals from continuing to
receive the allowance in a group of selected countries does not comply with the fundamental principle of proportionality nor do I venture with EU law or the Human Rights Act.
Thus, in anticipation of my application
being refused or dismissed I wish to put you on notice of my wish for any such refusal to immediately form the basis of a formal appeal to the First Tier of H.M. Courts and Tribunal Service by myself.
